Mario's Humidor

By creating an account or using Mario's Humidor ("the app," "the service"), you agree to these Terms of Service. If you do not agree, do not use the app. These terms apply to all users, including free and Pro subscribers.

Mario's Humidor is owned and operated by Mario's Humidor LLC, a California limited liability company. References to "we," "us," or "our" in these terms refer to Mario's Humidor LLC.

You must be at least 21 years old to use Mario's Humidor. By using the app you confirm that you meet this age requirement. We reserve the right to terminate accounts of users who do not meet this requirement.

You are responsible for maintaining the security of your account and for all activity that occurs under it. Use a strong password and do not share your credentials. Notify us immediately at support@marioshumidor.com if you suspect unauthorized access.

Mario's Humidor grants you a personal, non-transferable license to use the app for your own cigar tracking and lifestyle purposes. You may store your cigar collection, journal entries, sensor data, and related content in your account.

You may not:

• Use the app for any unlawful purpose
• Attempt to access another user's account or data
• Reverse engineer, copy, or resell any part of the service
• Use automated tools to scrape or abuse the API
• Upload content that is illegal, harmful, or infringes on others' rights
• Misrepresent your identity or affiliation

Mario's Humidor Pro is a paid subscription that unlocks additional features including cloud sync, advanced analytics, AI features, and unlimited cigars.

Automatic Renewal Disclosure (required by California law): Mario's Humidor Pro automatically renews at $59.99 per year unless you cancel at least 24 hours before the end of the current billing period. Your payment method will be charged within 24 hours prior to the renewal date. You may cancel at any time from your device's subscription settings or by contacting us at support@marioshumidor.com.

By subscribing you also agree to:

• Recurring annual charges of $59.99 until you cancel
• Cancellation takes effect at the end of your current billing period — you retain Pro access until then
• Refunds are not provided for partial billing periods, except where required by law
• We reserve the right to change Pro pricing with 30 days' advance notice

Payments are processed by Paddle. By subscribing you also agree to Paddle's terms.

You own the content you create in Mario's Humidor — your journal entries, photos, notes, and cigar data. By storing content in the app, you grant us a limited license to store, display, and process it solely to provide the service to you. We do not claim ownership of your content and will not use it for any other purpose.

Mario's Humidor uses AI (powered by Anthropic's Claude) for the Mario chat assistant, cigar band scanning, and journal note processing. AI responses are for informational and entertainment purposes and may not always be accurate. Do not rely on AI output for health, legal, or financial decisions.

We aim to keep Mario's Humidor available at all times but cannot guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service unavailability.

To the maximum extent permitted by law, Mario's Humidor and its operators are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

We reserve the right to suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

We may update these terms as the service evolves. We will notify you of material changes via the app or by email at least 14 days before they take effect. Continued use after changes constitutes acceptance.

These terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of California.
